Important Notice to Guests

This document is a legally binding contract issued by Trinchera Property Management, Inc., a Delaware corporation ( “Trinchera”) and accepted by you, on behalf of yourself and all other persons travelling under your reservation (including any accompanying minors or other persons for whom a reservation is made) (collectively, “you”), subject to the terms and conditions below (“Terms”).  By paying the Reservation Deposit (defined below), clicking “I agree” or “I accept,” or by a substantially similar mechanism, or by otherwise confirming a reservation, you acknowledge that you have read, understood, and agreed to these Terms.

THESE TERMS CONTAIN IMPORTANT LIMITATIONS ON THE RIGHTS OF TRINCHERA GUESTS. IT IS IMPORTANT THAT YOU CAREFULLY READ ALL OF THESE TERMS.

Deposit,  Cancellation, & Payment Policy

Reservation Cost. The cost of your reservation (“Reservation Cost”) is based on the applicable nightly rate of the room(s) you selected plus applicable taxes and required fees.  

Deposit. To confirm your reservation, you are required to provide a 50% deposit (“Reservation Deposit”) of your Reservation Cost. This deposit is non-refundable. The remaining balance of your Reservation Cost is due 60 days prior to your arrival. In the event you make a reservation within 60 days of your arrival, the entire balance of your Reservation Cost will be due immediately to confirm your reservation and will be non-refundable, subject to these Terms.

Cancellation by Guest. If you cancel more than 60 days prior to your arrival, Trinchera will credit the amount of your Reservation Deposit towards a future trip as long as your rescheduled trip takes place within 365 days of your original reservation dates, and any amounts paid by you over the Reservation Deposit will be refunded to you. If you cancel or modify your trip within 60 days of your arrival date, your payments are non-refundable, except that Trinchera, at its discretion, may, but is not required to, apply amounts paid (or any portion thereof) towards a rescheduled trip as long as the rescheduled trip takes place within 365 days of your original reservation dates.  No refunds will be issued for early departures, late arrivals, or unused services or activities.

Cancellation by Trinchera. Trinchera reserves the right to cancel or modify your reservation for any reason. In the event Trinchera cancels or modifies your reservation for any reason other than a Force Majeure Event (as defined below), Trinchera will refund all amounts paid by you or, at your option, apply such amounts as a credit towards a rescheduled trip, provided that such credit must be used within 365 days of your original reservation dates. In the event Trinchera cancels or modifies your reservation due to a Force Majeure Event, all amounts paid by you are non-refundable.

Failure to Timely Pay. Failure to remit full payment due by the stated due date may result in cancellation of the reservation. Any funds already deposited at the time of such cancellation are non-refundable.

Travel Costs; Travel Insurance. Trinchera shall have no liability whatsoever for any travel-related costs incurred by you, including but not limited to your costs and expenses related to air and/or ground transportation, insurance, visas, and other travel arrangements of any kind whatsoever. Trinchera highly recommends that guests purchase travel insurance or similar travel protection plan to help protect against financial loss due to cancellation.

Incidental Charges; Damage to Property.  You are responsible for paying any incidental charges and any charges for optional, additional services not included in the nightly rate and will be liable for any loss or damage to any real or personal property, including without limitation any damage to Trinchera property, equipment, and facilities.

Payment Terms. All payments due to Trinchera must be made in U.S. Dollars. Payments will be accepted by wire payment or credit card or in such other form as may be determined or approved by Trinchera from time to time in its discretion. If paying by wire, please contact Trinchera by telephone at +1 (855)-990-0043 to confirm procedures for sharing wire instructions. Upon making a reservation and by providing the Reservation Deposit, you agree that Trinchera has permission to keep your credit card information on file and you agree that Trinchera is authorized to charge the balance of your reservation amount to your credit card 60 days prior to your scheduled arrival date without any further written permission from you.

Room Occupancy. The occupancy of the room(s) you are reserving will be specified when you reserve the room(s), and you agree to comply with all such occupancy requirements.

Check-In and Check-Out. You may check in after 3:00 P.M. on your arrival date and must check out by 11:00 A.M. on your departure date. Trinchera, at its discretion, may be able to accommodate requests for early check-in or late check-out; please contact Trinchera to request such accommodation.

Date Change Requests. Requests to modify the dates of your reservation are subject to availability and may be accommodated at Trinchera’s discretion. All requests to modify the dates of your reservation are subject to Trinchera’s deposit and cancellation policy.

Private Group Reservations, Weddings, Events. Private group reservations, weddings, and other special event reservations may be subject to separate written agreement(s) with Trinchera and may require alternative deposit schedules pursuant to such separate agreement(s).

Inclusions; Activities; Exclusions; Additional Services.

Included Services. Your reservation amount includes the following services:

1.       Meals. Three meals per day served in the dining room or provided at other times and locations as may be determined from time to time by Trinchera in its discretion.
2.       Alcohol. Selection of house beer, wine, and spirits, as well as assorted beverages and snacks, provided that the provision of alcoholic beverages shall be in compliance with all applicable laws, regulations, licenses, and permits.  Alcoholic beverage service will be provided by Trinchera H&R Inc., an affiliated entity.  Trinchera and Trinchera H&R, Inc. reserve the right to refuse service to guests.
3.       Activities. Outdoor and recreational activities, which may include, but are not limited to: hiking and backcountry exploration, wildlife viewing, one half-day of guided flyfishing per reservation and other non-guided fishing and water activities (provided however that any required hunting and fishing licenses are excluded), shooting sports, mountain biking, snowshoeing, Nordic skiing, ice-skating and ice bocce, and other seasonal outdoor experiences. Activities offered by Trinchera are subject to modification or cancellation at Trinchera’s discretion, including for reasons such as weather conditions, safety considerations, wildlife activity, guest ability levels, and Trinchera’s operational requirements and capacity. Trinchera reserves the right to deny or modify guest participation in activities if doing so is deemed necessary for guest safety.
4.       Wellness Center. Access to Trinchera’s wellness center, sauna, and hot tub, and one massage per adult per reservation, subject to staffing availability, operating hours and maintenance closures.
5.       Equipment. Use of certain sporting equipment provided by Trinchera, including a variety of mountain and e-bikes, flyfishing equipment, snowshoes, cross-country ski gear and ice skates.

Additional Services. Certain additional services may be made available to you upon request, subject to Trinchera’s discretion, for additional charges, including certain overnight trips (such as outpost overnights), access to reserve wines and spirits, and custom activities.

Exclusions. All retail shopping is excluded from the Reservation Cost. Hunting and fishing licenses and permits, and all costs associated with such licenses and permits, are expressly excluded from the Reservation Cost and must be obtained pursuant to additional processes and may be subject to additional terms and conditions. If you are interested in hunting or fishing during your stay, please contact Trinchera directly for additional instructions.

Operational Circumstances. Trinchera reserves the right in its discretion to modify your accommodations or activity itineraries when operational circumstances require.

Guest Conduct. All Trinchera guests agree to behave in a respectful manner toward all Trinchera staff, other guests, wildlife, and the natural environment. Trinchera reserves the right to remove or restrict any guest whose behavior Trinchera determines (in its discretion) endangers themselves or others, harasses Trinchera staff, damages property, endangers or harasses wildlife, damages the natural environment, disrupts the experience of other guests, or violates any applicable rule, law, or regulation. Guests are not entitled to any refund in such circumstances.

Environmental Stewardship. Trinchera operates as a working landscape committed to conservation and responsible land stewardship. You hereby agree that you and all other guests in your party will adhere to all applicable laws, regulations, ordinances, and policies and all Trinchera guidelines regarding the conservation and protection of wildlife and the natural environment, including but not limited trail usage, fishing and hunting regulations, fire safety, and environmental preservation.

Force Majeure. “Force Majeure Event” means war, acts of any public enemy, civil disorder, terrorism, riot, fire or other casualties to any buildings or facilities at Trinchera’s property, flood, explosion, earthquake, adverse weather conditions, labor dispute, work stoppage or strike, shortage of goods and foodstuffs, labor shortage, epidemic or pandemic related to the outbreak of disease, virus, bacteria and other factors that may adversely affect human health whether occurring solely at Trinchera, in Costilla County, within the State of Colorado, or in the United States of America or beyond, quarantine restrictions, any act or order of any governmental authority, any other acts of god, and any other events beyond Trinchera’s reasonable control. If a Force Majeure Event occurs at any time that delays, prevents, or adversely affects Trinchera’s ability to provide accommodation and/or services to guests, or requires Trinchera to close some or all of the lodging and/or other facilities planned to be used in connection with these Terms, Trinchera has the right to cancel or modify your reservation with limited or no notice. If Trinchera cancels or modifies your reservation due to a Force Majeure Event, all amounts paid by you are non-refundable.

Other Policies.

Pet Policy. Trinchera welcomes service animals in compliance with applicable law. Trinchera may also accommodate well-behaved pet dogs, at Trinchera’s discretion, exclusively as part of a complete buyout of Trinchera’s Lodge or the entire Trinchera Property, subject to an additional fee of $100 per dog, per night. You are responsible for your dog’s behavior and agree that you are liable for all damage caused by your dog, including without limitation damage or injury to other persons or real or personal property.

Smoking Prohibited. Trinchera is a non-smoking property. Smoking is strictly prohibited in all areas of Trinchera’s property.

Minors. Minors are welcome at Trinchera but must be accompanied by a responsible adult at all times and must comply with these Terms.

Privacy Policy. You acknowledge and agree to comply with Trinchera’s Privacy Policy, located here:    Trinchera’s Privacy Policy  

Photography Policy. Photography or video recordings of the various works of art displayed at Trinchera’s property, including capturing images or footage where the artwork is a focal point or is reasonably identifiable, is prohibited. Without limiting the foregoing, guests are prohibited from publishing, posting, selling, licensing, distributing, or otherwise exploiting any images or recordings depicting or otherwise capturing the artwork for any commercial use. Any exception to this policy must be expressly authorized in writing by Trinchera in advance and Trinchera may impose conditions at its discretion to such authorization.

Assumption of Risk; Waiver; Liability; Limitation of Liability.

1.       Assumption of Risk. Participation by guests in Trinchera activities is voluntary and Trinchera requires all guests to execute separate written liability waivers, releases, and assumptions of risks upon or prior to arrival at Trinchera, but in any event prior to participation in any such activities; in the event of any conflict between these Terms and such separate written liability waivers, the terms and conditions of the separate written liability waivers will control. PARTICIPATION IN ACTIVITIES OFFERED BY TRINCHERA IS AT YOUR OWN RISK. You hereby acknowledge and agree that outdoor recreation and wilderness activities and travel involve inherent risks including, but not limited to: altitude, uneven terrain, changing weather conditions, potential forest fires and other dangerous natural occurrences, wildlife encounters, equipment malfunction or misuse, and physical exertion. You are aware and understand that outdoor recreation and wilderness activities and travel are potentially dangers and involve the risk of personal or psychological injury, pain, suffering, temporary or permanent disability, death, property damage, and/or financial loss. BY PARTICIPATING IN ACTIVITIES AT TRINCHERA, YOU AND ALL OTHER GUESTS IN YOUR PARTY VOLUNTARILY ASSUME THESE RISKS. Guests are strongly encouraged to contact their physician to discuss any health concerns before participating in activities at Trinchera.
2.       Waiver and Indemnification. You, for yourself and on behalf of your personal representatives, heirs, next-of-kin, spouse, and assigns, hereby expressly waive and forever release, and indemnify and hold harmless Trinchera and its affiliates and Trinchera’s and its affiliates’ respective officers, directors, shareholders, members, partners, managers, employees, contractors, agents, affiliates, successors, and assigns (each, a “Trinchera Party” and collectively, the “Trinchera Parties”), from and against any and all costs, loss, demands, claims, damages to persons or property, losses and liabilities, including without limitation reasonable legal fees and costs (collectively, “Claims”), now known or hereafter known, on account of any injury, disability, death, property damage, or financial loss arising out of, relating to, or attributable to your participation in activities at Trinchera and your access to, use of, and presence on Trinchera’s property, whether arising out of the ordinary negligence of yourself, third parties, Trinchera, the Trinchera Parties, or otherwise.  You covenant, for yourself and on behalf of your personal representatives, heirs, next-of-kin, spouse, and assigns, not to make or bring any such Claims against Trinchera or the Trinchera Parties, or any of them.
3.       Limitation of Liability. To the fullest extent permitted by applicable law, in no event shall Trinchera or any Trinchera Party be liable to you or any guest in your party for any incidental, consequential, indirect, statutory, special, exemplary, or punitive damages, or for damages for lost profits, loss of use, loss of time, inconvenience, lost business opportunities, loss of data, damage to goodwill or reputation, or costs of cover, arising out of or relating to any Claims, regardless of whether Trinchera or the Trinchera Party has been advised of the possibility of such damages and regardless of whether such damages were reasonably foreseeable, and regardless of whether the Claims are based on breach of contract, tort (including negligence), strict liability, statute, or otherwise.

Miscellaneous. These Terms shall be governed by and construed in accordance with the laws of the State of Colorado. Any claim or cause of action arising under these Terms may be brought only in the state courts located in Costilla County, Colorado, or the federal district court for the State of Colorado, and you hereby consent to the exclusive jurisdiction of such courts. If anything in these Terms is or becomes invalid or unenforceable, these Terms will be enforced to the fullest extent permitted by applicable law and you will still be bound by all of the other terms. In the event Trinchera incurs any legal fees, costs, or expenses to enforce these Terms or any of its rights provided hereunder, Trinchera shall be entitled to recover its reasonable legal fees, costs, and expenses, including any court, arbitration, mediation, or other litigation expenses.

Acceptance of Terms. By paying the Reservation Deposit, clicking “I agree” or “I accept,” or by a substantially similar mechanism, or by otherwise confirming a reservation, you (i) acknowledge that you have read and understand these Terms, (ii) agree to be legally bound by these Terms, and (iii) represent that you have the legal capacity and authority to agree to these Terms.
